This Privacy Policy specifically describes how Y u m e C o n s u l t s LLC, a registered California foreign corporation (referred to herein as “LoveThrive™,” “Company,” “we,” “us,” or “our”), collects, uses, and shares information when you use the DIY Affiliate LoveThrive™ Program (the “Program”) and its related services. This Program-specific Privacy Policy should be read in conjunction with LoveThrive™’s main Privacy Policy, which governs data practices across our broader services. By accessing, using, or purchasing the Program, you also agree to the full Program’s Terms of Service, including its provisions for dispute resolution and class action waiver.
1. Information We Collect
When you register for access, complete any forms or use the Program (including Indie, Startup, and Business tiers), we collect the following types of information (where applicable):
- Account Information: Your name, email address, password, company name, business address, phone number, and billing details (e.g., credit card information) required to set up and maintain your account.
- Program Data: Information related to your affiliate program’s operation within LoveThrive™, including:
- Affiliate details (names, contact info, commission rates you set).
- Referral and conversion data (e.g., clicks, sales generated, commissions earned by your affiliates).
- Payout records and related financial transaction details.
- Campaign performance data.
- Communication Information: Records of your communication with us, including customer support inquiries, feedback, and survey responses.
- Technical & Usage Data: Information about how you access and use the Program, including your IP address, browser type, operating system, device identifiers, pages viewed, time spent on pages, referral source, and features used. This is collected automatically through cookies and similar technologies.
2. How We Use Your Information
We use the information we collect to:
- Provide and Operate the Program: To create and manage your account, process transactions, deliver the services you’ve subscribed to (across all tiers), and allow you to manage your affiliate programs.
- Support & Communication: To provide customer support, respond to your inquiries, and send you important service-related notices and updates (e.g., changes to features, billing, or these policies).
- Improve the Program: To understand how users interact with the Program, troubleshoot issues, develop new features, and enhance user experience.
- Billing & Accounting: To process payments, manage subscriptions, and for internal accounting purposes.
- Security & Fraud Prevention: To protect the integrity and security of the Program, detect and prevent fraud, unauthorized access, and other malicious activities.
- Marketing & Advertising: To deliver relevant advertising to you about LoveThrive™’s services (both within and outside the Program), and to measure the effectiveness of our campaigns. This includes using cookies and similar technologies to show you ads on other websites or platforms.
- Legal Compliance: To comply with applicable laws, regulations, and legal processes.
3. How We Share Your Information
We do not rent, sell, or trade your personally identifiable information to any third parties for any purpose. We may share your information only in the following, strictly defined circumstances:
- Disclosures for Business Purposes: To operate our services and fulfill transactions, we disclose certain categories of personal information to third-party service providers. These providers are contractually restricted from using your information for any purpose other than providing services to us.
- Payment Processing: We disclose identifiers and financial information (such as name, email, and billing details) to Third-Party Payment Processors to securely process your payments and prevent fraud.
- Internal Affiliate Management: We utilize Proprietary Internal Systems to track referrals and manage commissions. Data used for these purposes is processed within our own infrastructure and is not sold or shared with outside marketing parties for their own independent use.
- Service Providers: With trusted third-party service providers who perform services on our behalf (e.g., payment processors, cloud hosting, customer support, analytics, marketing, security services) to enable them to provide those services. These providers are contractually obligated to protect your information.
- Your Affiliates: Information relevant to your affiliates’ performance and payouts will be accessible to those specific affiliates through your program’s dashboard as managed by you.
- Legal Requirements: When required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
- Business Transfers: In connection with a merger, acquisition, sale of assets, or other corporate transaction.
- Aggregated/Anonymized Data: We may share aggregated or anonymized information that cannot reasonably be used to identify you, with third parties for research, marketing, analytics, or similar purposes.
4. Cookies and Tracking Technologies
We use cookies, pixels, and similar tracking technologies to collect information about your browsing activities and interactions with the Program. These technologies help us remember your preferences, analyze usage, provide relevant advertising, and improve security. Please be aware that disabling cookies through your browser settings will severely impact the functionality and your ability to use the Program effectively. We cannot deliver our Program experience as intended if you choose to do so and this may severely compromise the desired outcome for your affiliate referrals.
5. Your Choices and Rights
- Account Information: You can review and update your account information through your Program dashboard.
- Marketing Communications: You can opt-out of receiving promotional emails from us by following the unsubscribe instructions in those emails. Please note that you cannot opt-out of receiving essential service-related communications.
- Do Not Track: We do not currently respond to “Do Not Track” signals.
- California Privacy Rights (CCPA): Our business does not meet the specific thresholds for compliance with the California Consumer Privacy Act (CCPA), and we do not rent or sell your personal information. Therefore, we are not required to, and do not, extend specific CCPA rights (such as the right to know, delete, or opt-out of sale) to our users under CCPA. For users located outside California, or where CCPA does not apply, your privacy rights may be governed by other applicable laws, as detailed in LoveThrive™’s main Privacy Policy.
6. Security
We implement reasonable technical and organizational measures to protect your information from unauthorized access, loss, misuse, or alteration. However, no internet transmission or electronic storage is 100% secure, and we cannot guarantee absolute security.
7. Changes to This Program Privacy Policy
LoveThrive™ reserves the right, at its sole discretion, to modify or replace this Program Privacy Policy at any time. If a revision is material, we may not make you aware of any updates so we suggest you bookmark this Program Privacy Policy and check back regularly. What constitutes a material change will be determined at our sole discretion. Your continued use of the Program following the effective date of any revised Program Privacy Policy shall constitute your acceptance of such revisions.
